The choice and purchase of a service is the sole responsibility of the client.

Any hotel room booking made under these conditions implies full and unconditional acceptance by the client of the specific conditions of the provider, the conditions of sale of the reserved rate, and these general terms and conditions of sale. Unless proven otherwise, the data recorded in the service provider’s computer system constitutes proof of all transactions concluded with the client. The client acknowledges having read the nature, purpose, and booking methods of the services offered by the hotel and having requested and obtained the necessary information to make an informed booking. The client is solely responsible for their choice of services and their suitability for their needs, so the hotel’s liability cannot be sought in this regard.

 

The client undertakes to provide accurate and truthful information when filling out the booking form.

 

The contractual information is presented in french and confirmed no later than when the client validates the booking.

 

For online bookings, a booking is registered on the service provider’s website when the client accepts these general terms and conditions of sale by ticking the box provided for this purpose and validating their booking. The client can verify the details of their booking, the total price, and correct any errors before confirming their acceptance (article 1127-2 of the civil code). Cancellation/modification of a flexible rate booking:

Clients who booked a fully refundable rate can cancel or modify their booking without penalty on hollywoodhotelcannes.com (provided the same rate condition of the original booking applies to the modified booking).

Cancellation/modification of a non-flexible rate booking:

Clients who plan to stay at the hotel can, up to 4 weeks before their stay, modify their booking to a later date without modification fees (subject to availability, rates, and applicable conditions) or request a voucher for the total value of the original booking to be used, in one or more transactions, at the same hotel within 18 months from the date of issuance of the voucher. If the reserved hotel is closed on the stay date, you can cancel your booking and be refunded without penalty.

To modify the dates of your stay or cancel, please contact the hotel directly.

Note: refund requests and voucher issuance can take up to 90 days from the cancellation date to process. The form and timing of the requested refund may be subject to laws applicable in metropolitan france.

Booking through a third party:

All third-party booking channels must comply with the hollywood hotel cannes’s cancellation policy described above. Clients who booked via a travel agency, an online booking platform, or another third-party channel are invited to contact the relevant booking entity directly to learn about the options for any modifications, cancellations, or voucher requests that apply to their booking.

Terms and conditions for vouchers:

– the voucher is valid only if payment has already been made.

– the voucher is valid only if the booking has not already been canceled.

– the voucher is valid only if no refund has been made.

– the voucher is non-transferable.

3. Rates

The prices for booking the services are indicated before, during, and after the booking.

For accommodation services, prices are indicated per room for the number of persons and the selected date.

When confirming a service booking, the total price is indicated to the client, including vat in euros.

Unless otherwise stated on the website, options (e.g., breakfast, half-board, full-board, etc.) Not offered at the time of service booking are not included in the price.

The tourist tax, presented during the service booking process, is payable directly at the hotel the hollywood hotel cannes unless prepaid online before the stay, where this amount may be included.

Prices include vat applicable on the booking date, and any change in the applicable vat rate will be automatically reflected in the price indicated on the billing date.

Any new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the price indicated on the billing date.

4. Payment methods

General information

The client provides payment details either to prepay the booking before the stay or as a booking guarantee by entering their credit card details (secured by ssl encryption) directly in the designated area when booking online. The credit card must be valid at the time of stay, and the security code is required for prepayment through the payment platforms mentioned below.

Prepayment

Prepayment is any payment made at the time of booking by the Client.

During prepayment, the amount debited includes the total amount indicated at the time of booking (including all applicable taxes, except for local taxes for non-classified establishments) and, if applicable, the price of the options selected by the Client.

Bank Guarantee

The booking guarantee by credit card means taking the Client’s payment details during booking. The Client’s credit card is not debited, and the stay payment is made directly at The Hollywood Hotel Cannes on the day of departure unless the Client does not show up at the hotel and has not previously canceled the booking according to the rate’s cancellation conditions.

Pre-Authorization

If the Client has not prepaid online for their stay, The Hollywood Hotel Cannes may request a pre-authorization (a reserve for future payment) from the Client’s bank via the Client’s credit card on the day of arrival, up to the amount of the booking plus a fixed amount to cover any on-site expenses (breakfast if not included in the rate, restaurant, bar, local taxes if applicable, etc.). This fixed amount is determined by The Hollywood Hotel Cannes based on the number of people and the number of nights booked.

Example: 2 nights at 130 euros + 40 euros estimated for extras = 300 euros pre-authorization request.

A pre-authorization is not an immediate debit but a reserve authorized by the Client’s bank, temporarily reducing the credit card’s limit for future debit. In some cases, depending on the Client’s bank, the pre-authorization may appear as a pending debit on the associated bank account.

When the pre-authorization is activated and confirmed by the Client’s bank:

  • The Client arrives at the hotel, and the total stay payment is made directly at the hotel upon arrival or departure. The hotel will then request a release of the pre-authorization from the Client’s bank. Any on-site expenses will be paid by the Client upon departure from the hotel.
  • If the Client does not arrive on the first day of their booking, the hotel will send a debit request to the Client’s bank.

In rare cases, the pre-authorization request may result in a debit by the Client’s bank before the actual debit. In this case, the debit will not occur twice. The balance, if in favor of the Client, will be automatically credited by the bank.

If the booking is canceled after the pre-authorization request is activated following the reserved rate’s cancellation conditions, a cancellation request for the pre-authorization will be automatically sent to the cardholder’s bank. In rare cases, this cancellation may appear as a refund.

Note that releasing the pre-authorized amount (or refund) usually takes twenty-four (24) to forty-eight (48) hours but may take up to seven (7) business days or more, depending on the cardholder’s bank.

To activate a pre-authorization request, the Client is invited to provide their credit card details to guarantee the booking. The Client is informed in advance of the pre-authorization request’s characteristics. Credit card data is stored only by the payment service provider.

If the Client has not prepaid online and no pre-authorization has been requested during booking, The Hollywood Hotel Cannes may request a pre-authorization upon arrival to guarantee payment for on-site services.

Client No-Show

In case of the Client’s no-show on the first day of their accommodation booking, the Client’s booking will be entirely canceled, and The Hollywood Hotel Cannes will re-list the reserved accommodation services:

  • If the no-show booking is non-cancellable, non-exchangeable, and non-refundable, The Hollywood Hotel Cannes will retain all amounts paid by the Client at the time of booking as a deposit under articles 1590 of the Civil Code and L 214-1 of the Consumer Code in their current versions.
  • If the no-show booking is cancellable, exchangeable, or refundable guaranteed by credit card, The Hollywood Hotel Cannes will charge the credit card provided at the time of booking the total amount of the first night booked, with additional nights (beyond the first night) being canceled without fees. The Client is informed that in such a case, The Hollywood Hotel Cannes will re-list its rooms. The Client is not entitled to any refund or compensation.

During prepayment of a non-cancellable, non-exchangeable, non-refundable booking, the deposit debited includes the total amount indicated at booking and, if applicable, the price of options selected by the Client, as described herein.

Modification or Cancellation of Accommodation Services

For accommodation services (booking rooms at The Hollywood Hotel Cannes), it is reminded that the Client does not have the right of withdrawal provided in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code, which excludes this right for accommodation services to be provided on a specific date or period.

For each Service booking, the Conditions specify the cancellation and/or modification terms of the booking.

Bookings with prepayment cannot be modified and/or canceled. Deposits (advance payments) are non-refundable. This is mentioned in the Conditions.

When Conditions permit:

  • Booking cancellation can be done directly on the website through the “Consult or cancel your reservation” section.
  • Booking modification can be done directly with the Establishment, whose contact details, including phone numbers, are specified in the booking confirmation sent via email.

In case of Service interruption by the Client, the entire agreed price will be charged. For prepayment bookings before the stay, no refund will be granted.

For accommodation services, unless otherwise expressly stipulated in the Special Conditions, the Client must leave the room before the time indicated by the Establishment, usually 12:00 PM on the last booking day. Otherwise, an additional night will be charged.

5. SERVICE PROVISION

The Services booked by the Client, including room reservations and additional services, will be provided as per the conditions outlined in these General Terms and Conditions of Sale, supplemented by the Conditions of Sale for the rate the Client has reviewed and accepted during the online booking process.

Upon arrival, the Client will be required to present identification to complete a Police Form.

The Hotel is entirely non-smoking. The Client will be held responsible for any direct and/or indirect, consequential damages resulting from smoking in the Hotel. The Client will, therefore, be liable for the total cost of cleaning and restoring the damaged element or area to its original state.

Pets, if kept on a leash or in a cage in the public areas, may be accepted according to the Hotel’s current policy for an additional fee. For hygiene reasons, pets are allowed in dining areas only if leashed.

The Client’s personal belongings left in the hotel room or public areas are their sole responsibility. The Hotel is not responsible for any loss, theft, damage, or destruction of these belongings.

The Client agrees to use the room responsibly. Any behavior contrary to good morals and public order will lead the Hotel to ask the Client to leave the establishment without any compensation or refund if payment has already been made. If no payment has been made yet, the Client must pay for the nights consumed before leaving the establishment.

The Client will be responsible for any direct and/or indirect, consequential damages they cause within the reserved room or the Hotel. Therefore, they agree to indemnify the Hotel for such damages, without prejudice to any damages and legal fees the Hotel may incur.

Free WIFI access may be provided according to the Hotel’s policy. The Client agrees that the hotel’s internet resources will not be used for reproducing, representing, making available, or communicating to the public works or objects protected by copyright without authorization. If the Client fails to comply, they may face charges of counterfeiting, punishable by a fine of 300,000 euros and three years’ imprisonment. The Client must also adhere to the hotel’s internet security policy.

The room will be available to the Client at 3 PM on the day of arrival and must be vacated by 12 PM on the day of departure. Otherwise, an additional night will be charged. The Client must check their departure date. If the departure date is earlier than planned, an additional night’s fee will apply unless the Hotel is informed at least 24 hours in advance.

The Service Provider will make every effort to provide the booked Services under an obligation of means. The Client has 8 days from the departure date to make any claims or reservations in writing regarding the Services provided. Any claims outside this period will not be considered.

In case of overbooking or force majeure, the Hotel may arrange accommodation in a similar hotel, subject to the Client’s prior agreement.

6. RIGHT OF WITHDRAWAL

According to article L 221-28 of the Consumer Code, the Client does not have the right of withdrawal provided in article L 221-18 of the Consumer Code due to the nature of the services provided.

The contract is, therefore, definitively concluded upon the Client’s booking according to the terms specified in these General Terms and Conditions of Sale.

7. SERVICE PROVIDER LIABILITY – WARRANTY

The Service Provider guarantees the Client against any lack of conformity or hidden defect, arising from a fault in the execution of the Services booked and paid for, under the conditions and terms defined in these General Terms and Conditions of Sale.

The Services provided via the Hotel’s website comply with French regulations. The Service Provider is not liable for non-compliance with the regulations of the country where the Services are provided, which the Client is solely responsible for verifying.

8. DATA PROTECTION

In accordance with the Data Protection Act of January 6, 1978, the personal data requested from the Client is necessary for processing their booking and issuing invoices.

These data are processed by the Hotel and may be communicated to its partners responsible for executing, processing, managing, and paying for the Client’s bookings and stay.

The Hotel may send clients newsletters, promotional offers, and satisfaction surveys via email following their stay.

The processing of information via the Hotel’s website has been declared to the CNIL.

The Client has the right to access, modify, rectify, and oppose their personal data at any time under national and European regulations.

This right can be exercised under the conditions defined on the Hotel’s website.

9. INTELLECTUAL PROPERTY

10. COMMITMENTS AND RESPONSIBILITIES

Hotel Commitments:

The Hollywood Hotel Cannes commits to providing access to the website and the Services offered, adhering to the General Terms and Conditions, acting diligently and competently, and addressing any issues promptly.

However, the Hotel may temporarily suspend the website without notice for technical maintenance reasons, without liability.

The Client acknowledges that the Hotel is not responsible for internet-related inconveniences or damages, including poor data transmission/reception, hardware or communication line failures, and internet network malfunctions affecting the website’s operation or Service reservations.

The website may link to third-party websites, for which the Hotel disclaims responsibility for their content and services. Consulting third-party websites is the Client’s responsibility.

In case of disputes or claims related to a stay or Service reservation, the Client must address the operating company of the concerned establishment, not The Hollywood Hotel Cannes.

Client Commitments:

The Client is solely responsible for their Service choices and suitability on the website, and for the accuracy of the information provided when creating an account and making a reservation.

The Client must notify The Hollywood Hotel Cannes immediately of any misuse or fraudulent use of their email address.

The Client agrees to use the website and Services according to applicable regulations and these General Terms and Conditions. Any breach of these obligations will make the Client liable for damages caused to The Hollywood Hotel Cannes or third parties.

The Client, in particular, agrees to pay the price for the booked Service and comply with the relevant Special Conditions.

The Client must not bring individuals to the hotel whose behavior may harm the establishment.

Bringing external food or drinks into the establishment is prohibited unless authorized.

Smoking is prohibited within the establishment, except on terraces and outdoors.

Disruptive behavior will lead to the Client being asked to leave without any refund if payment was made.

Minors can only stay at the hotel accompanied by an adult with valid ID. If the adult is not a parent, they must have parental authorization.

The Client is responsible for any damages caused by themselves or their guests and bears all associated costs.

11. FORCE MAJEURE

Neither party will be liable if the non-performance or delay in performing any of their obligations results from a force majeure event under article 1218 of the Civil Code.

If a force majeure event lasts more than 30 days, either party may terminate these General Terms and Conditions without any compensation.

In such cases, the Hotel may arrange alternative accommodation or similar Services with the Client’s prior agreement, covering reasonable transfer expenses.

12. MISCELLANEOUS PROVISIONS

These General Terms and Conditions, the Personal Data Charter, the rate conditions selected by the Client, the booking request, and the booking confirmation constitute the entire agreement between the parties.

No tolerance or leniency will be deemed to create any right and will not limit the ability to invoke any clause of these General Terms and Conditions.

If any clause of these General Terms and Conditions is declared void or illegal, it will not affect the validity of the remaining clauses.

13. APPLICABLE LAW – LANGUAGE

These General Terms and Conditions and resulting operations are governed by French law.

The General Terms and Conditions are written in French. In case of translation, the French text prevails in case of dispute.

The Client agrees to remain courteous and not make disparaging remarks towards The Hollywood Hotel Cannes, its establishments, employees, or collaborators. The Hollywood Hotel Cannes reserves the right to take appropriate measures against the Client in case of prejudicial or reprehensible behavior.

15. DISPUTES

All disputes related to purchase and sale operations under these General Terms and Conditions will be subject to the competent courts under common law conditions.

Consumer Complaints and Disputes

In case of unresolved complaints, the Client must submit the dispute in writing to our company. The Hotel will aim to address any substantiated requests within a maximum of three (3) weeks.

In case of necessity, parties retain the right to take the matter to the competent court.

16. PRE-CONTRACTUAL INFORMATION – CLIENT ACCEPTANCE

The Client acknowledges having received, before booking and concluding the contract, clear and understandable information on the General Terms and Conditions of Sale and all listed information under article L. 221-5 of the Consumer Code, including:

  • Essential characteristics of the Services;
  • Service price and any additional fees;
  • If applicable, the date or deadline by which the Service Provider commits to providing the reserved Services;
  • Information on the Service Provider’s identity, contact details, and activities;
  • Information on legal and contractual guarantees and their implementation;
  • Digital content functionality and interoperability, if applicable;
  • The possibility of conventional mediation in case of a dispute;
  • Important contractual conditions;
  • Accepted payment methods.

By booking on the Hotel’s website, the Client fully accepts these General Terms and Conditions of Sale and agrees to pay for the ordered Services.
